Legal Question in Real Estate Law in Colorado

Buying a home with a partner

I am buying a home with my girlfriend. We are both on the loan and title. What should we consider when making a contract that keeps us financially safe in case of a break up?

Re: Buying a home with a partner

If you are planning to get married, you should have a pre-nuptial agreement. If not, you should have a buy-sell agreement that spells out what happens if one party wants out or dies. You should consider purchasing the property in the name of an LLC to be created with you and your partner as the members/managers. The Operating Agreement could then spell out what happens if one member dies or wants out, and the property could stay with the party remaining.
