HUD manufacured and UBC code homes verses Mobil homes

A subdivision I have purchased land in has a covenant

that stipultes "no mobils allowed " as a condion for building a home . They are demanding a UBC or Site

built home . Is a HUD maufactured home when placed on

a permanent foundation a mobil home ? A UBC home is

allso a manufactured home and seems to be a building

code only . Since both are transported on wheels and

in sections and both can be placed on permanent foundations . How can the HUD manufactured home be a

mobil when attached to a permanent foundation ?

This is the definition of a "mobile home" under CO law:

6.3) "Mobile home", for the purposes of construction inspection and certification, means a structure, transportable in one or more sections, which is eight body feet or more in width and is thirty-two body feet or more in length and which is built on a permanent chassis and designed to be used as a dwelling without permanent foundation when connected to required utilities, and includes the plumbing, heating, air-conditioning, and electrical systems contained therein.

The factory-built home you describe would seem to be outside the "mobile" definition if it is designed to be placed upon a permanent foundation and is UBC approved.

This can be a tricky area. You should get an opinion from a CO lawyer who has all the facts and documents to review before taking too strong a stand.
