Legal Question in Wills and Trusts in Colorado
My Grandmother passed away in late November. We have left her bank account open since then so that any money which was directly deposited into her account after her death could be taken back out by the respectful companies. There is now less than $100 in her account and we would like to close it out. The bank is requesting a small estate affidavit for this. I am just wondering what kind of hoops are entailed in filing this affidavit and if it will even be worth all the trouble for less than $100? Thanks for your help!

There are several issues here, but I will answer the question relating to the small estate affidavit. If your grandmother's estate did not include any real property and the value of her assets was less than $50,000, then you can use a small estate affidavit. Otherwise, you shall not use a small estate affidavit. You can get a small estate affidavit and instructions for its use at the Colorado courts website.
