You can file suit in either small claims court or superior court. If you file in small claims you can only claim up to $5000.00 plus the filing fee. The court will take care of service upon the defendant. If you file in superior court, there is no limit on the damages but you have to serve the defendant by marshal. LLC means limited liability company. If you are going to file in superior court there are special rules when serving business entities.

Depending on the type of car case you are filing you also may wish to file in federal court. Certain statutes trigger a federal action. If the paperwork used to purchase the vehicle violated truth in lending law or if there is odometer fraud you may wish to cite TILA, moss magnuson warranty act, and the odometer and cost savings act. If the car is just a lemon you need to qualify under lemon laws which depend on the year mileage and ammount of money used to purchase as well as ammount of time you have returned the vehicle. These are all ways to maximize your damages. You should definitely consider hiring an experienced consumer lawyer to handle your case. Some of the statutes listed above allow you to recover attorney fees and an attorney may take your case without a retainer based on that. Otherwise you may be completely out of your depth in civil or federal court. If you go it alone then your best bet is small claims.
