Relinguishing Maternal Rights

I need to find out some advice on

removal of parental rights. My

husband has a son who is 10. He

has not seen or heard from his

mother in 2 years. She has been in

and out of drug and alcohol rehab

since before he was born. My

husband has had full custody since

he has been 4. My step son wants

nothing to do with her and is very

scared to ''run into her'' at the store

or just around town. My husband

and I both want me to adopt him. I

have been his ''mother'' since he was

5 years old. Is there anything that

we can do?

You can apply to the probate court for a termination of her parental rights. Start there. If you feel you need an attorney, contact me again.

You will have to proceed first with terminating the mother's parental rights. From the facts stated it seems you have a good chance of success. Only after her rights are terminated can you attempt to adopt your husband' son. If you need further help, you can email me at [email protected].
