My brother and I are half owners of my parents house. How can I buy him out?

You make him an offer. If he accepts it he would "quit claim" his interest to you via a quit claim deed. There are forms for this document and it must have the proper wording in it, be signed by him in the presence of two witnesses and a notary. The document must then be recorded on the land records of the town where the property is located.

If your brother does not agree to having you buy him out, a court cannot force him to do so. The only thing a court can do is order that the property be put up for sale.
