execution of a will

My father's will ststed that upon his death the funerak expenses were to be paid out of his estate immediatly. My mother insisted that we meet her at the funeral home, we meaning the children, we did and she told the funeral director that she did not have the money to pay for the funeral even though we knoew shr did. Does this make her incapable of beinf executor whenthe first part of the will was not carried out not to mention how terribly disrespectful to our father's memory.

You didn't mention if your father's estate had any money, and if it did, whether it went to your mother.

You also did not mention if the will has been probated as of yet.

You may probate the will and then ask the probate court to remove your mother as executrix and appoint one of the children including yourself.
