Probate

My mother passed with 50%

survivorship of a home&property. My

aunt (Mom's sister in law) owns the

other 50%. She lives hand to mouth

and was in danger of losing the home

due to back taxes (before mom died).

My aunt is not willing to sell the

home. This is a ''cash poor'' estate.

How long could this drag on? The

estate was opened 6/5/08.

You say the estate was opened on June 5th and is cash poor. If so, why was it even opened. The house and property passed to your Aunt outside of probate because they owned it jointly with rights of survivorship.

Your Aunt can do anything she wants with the house. It's hers.
