Legal Question in Business Law in Florida

laws applicable to homeowners associations

We are having a number of issues with the Board of Directors of our local homeowners association. One of the issues centers around the President not being willing to allow any of the association's records to be inspected. In order to understand how to take legal action, I first need to understand what the association's disclosure duties are under Florida law. I have found the Association files an annual report to the state under the not-for-profit corporation uniform business report. ''Homeowners Association'' is part of their legal name.

I am wondering if the Florida Statutes, Chapter 617 or Chapter 720, or both will apply to this association. Once I know that, I can determine how to best write my letter requesting association records.

There is a legal requirement under Chapter 720 for those disclosures you seek. Please advise if we can be of further aid.
