Legal Question in Credit and Debt Law in Florida

I am being sued by a auto finance company. I feel I was takin advantage of.

I purchased a new 1998 automoble for approx. $16,000.00. I made payments of $421.55 totaling $9274.10. I called to find out what my pay-off was. I was told it was $16,000.00. I told the finance company they can come and pick up the car, which they agreed. it was later sold at auction for approx. $8,000.000. this totaling approx. $17,000.00. I am now being sued in civil court for a balance they say is $6,714.17. this is totaling up to approx. $23,700.00. I have made 2 seperate offers to settle this once for $3,000.00 and then for $4,000.00 to be made in payments with out interestto cover the original interest of 17% and fees that were incurred for the car to be auctioned. They are dead set on $6,714.00 to be made in payments with interest or a lump sum of $4,500.00 that I do not have. I have 20 days from 6-4-01 to provide a response to the summons I received. I am trying to resolve this matter. I do not know what to do from this point, as far as a formal response to the summons and how could I tell the Judge, that I was threatened by the finance company with garnishment of wages with out due process, repeated telephone harrassment and that I feel I am paying too much to settle this dispute.

If you have been threatended you can countersue under the Fair Debt Collection Act for damages. You should hire an attorney this matter can be difficult
