Legal Question in Criminal Law in Florida

Battery on LEO, Disorderly conduct, Resit of arrest w/o violence.

The state offered me a plea of 2 years probation, and 2 years angermangment.. my Public defender advised me to go to trial.. I am not sure as to the compitence of the defender. Altough I fouht back when the officers tried to force me out of the building, I had no intentions of striking him it was a natural reaction. the officer could have easily overpowered me.. Should I regect the plea, or face a possible jail sentence, and take my chance at trial.

You have just asked a question that only you can answer. The decision to go to trial or to enter into a plea that would avoid a trial is solely a decsions that an accused person must make on their own, after weighing all of the pros and the cons. No one can make this decision but you.

My personal opinion is that juries are not likely to convict people who are willing to get on the stand, look the jurors in the eye, and say I did not do it. But every attorney is dfferent.

Reflex is not really a good defense for this sort of thing. If you lose at trial batt on a leo it scores 21 month min prison. Did your lawyer tell you that?
