illegal arrest

I was wondering if there is anything that has to do with illegal arrests due to ''diminished capacity'' resulting from drunkenness and head injury?My husband has been arrested and there are a couple of things concerning his arrest that made me pay attention to;first the police was sent to our home under the guise of''checking on him because of suicidal fears'';the victim has not called the police herself,but a friend of hers did;the victim has not identified my husband personally,she identified him by his driver's license photo;the interview with the victim was taken when she was influence of Loritab(it's pain killer medication);the interview with my husband was done when he visibly needed medical attention(but none was offered or provided).Having these things in mind,can we establish that his arrest was illegal?
