Miranda Warnings/ror

I was arrested last night and charged with petty theft. I was released ROR and given a court date. I was never read my miranda rights. I didn't know if this was relevant to my charge and I also wanted to know if I need a lawyer for my court date (this is my first charge) and what I can expect to be sentenced to.

1. The failure to read your Miranda warnings is only significant if the state wants to use your statements against you.

2. You won't find many lawyers telling you that you don't need a lawyer.

3. You could expect anything from a diversion program where the charges would be dropped after you completed some program to 1 year in the county jail and a $1,000.00 fine. For a first offense, jail time would be unlikely, but not unheard of.

4. Get a lawyer familiar with the local prosecutors and judges, and he'll be able to offer you a better prediction. You'll feel better having someone handling the matter, and not trying to stumble through it yourself.
