Legal Question in Criminal Law in Florida

police harrassment

My friend was accused of being a middle man , in a trade of meth for a stolen car by a person in county jail,. So on that info the police come to my friends house and ask to search inside his house and he complied they looked around his property inside and out than began questioning and got rude so he told them just 2 leave they saw every inch of his property before the rudeness began .than the the following day they went to his wife's work [who by the way was never mentioned in the accusation of car for meth trade] and told her employers she was invovled in drugs and stolen vehicles working for a doctors office they immediatly had her drug tested she passed ,her employer called their boss and said their tactics seemed out of line and that was basically the end of that, the husband was arrested on grand theft auto and conspiracy and organized auto theft ring or similar to he bailed out spent 3,000.00 on a lawyer and never saw a court room it all got thrown out, all this happened based on a thiefs word .Now I am pushing my friend to take the police officers to court and sew for his bail money [300.00] and for defamation of character for his wife he is not sure if he could do this please tell us where they stand on this issue.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

This would be a very difficult case to win and the damages, if successful, would probably far surpass the costs involved to prosecute the case. It is unlikely that your friend would be able to find an attorney to take the case on a contingency, so he would have to pay hourly rates for an attorney which will probably disuade him from trying this. If a witness provides information to believe that a crime may have been committed, it is reasonable for the police to act on that information.
