Legal Question in Criminal Law in Florida

Prescription drug and Insurance fraud

My EX daughter in law was arrested on 29 counts of prescription drug and insurance fraud. These were written to her by the dr she worked for. He was arrested for as well. They are both out on bail. Is there any possible way for her to avoid jail time. SHe has residential custody of my two small grandchildren. THe courts in Fl think they are fine as she is innocent until proven guilty. Not only did she get prescriptions filled she didn't need, She charged them to her insurance co. Can she get off with Fines and Probations only?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

Anything is possible. Many times, the party with the lesser culpability will agree to cooperate with the State and testify against the other party. In return, a much lesser sentence or even probation is offered. You will just have to watch and see how it plays out.

Re: Prescription drug and Insurance fraud

You should be able to negotiate a good plea to this depending on whether she has any prior convictions.
