50/50 chance of winning in federal court

Would you advise a client to settle if they had a 50/50 chance in federal court?

Yes. If it is truly 50-50, then a bird in the hand is definitely worth two in the bush. Litigation is time-consuming, stressful, costly, full of unpleasant surprises and unpredictable. If the settlement is within reason, take what you can get. But only you know if the settlement is worth it for you.

There is a 50/50 chance I would advise them to settle. Seriously, there are other factors to consider than simply your chance to prevail. What is the offer on the table, what is your best result, what is the real downside/upside to winning/losing, can you handle the stress of trial, will a loss/victory have any long term effects on you or others?
