community age restriction by builder

I have placed a 2500 dollar deposit on a built home in a age restricted community 55 +. according to the bylaws and covnants 80% have to have this age reached the other 20% have to be above the age of 18 and can be below 55. i am 54 (i will be 54 in a month) the day i was to sign the contract and give them the other 2500 deposit the sales person asked if i was 55 when i told her no she said that lennar has a policy that they would sale to those 55 and older first. the covenants which specifically state the above.

i feel this is an age descrimination issue against the fair housing act. this company receives federal monies fha and va loans.

could you comment on this and has there been any precidences set for this type of case. my realitor was with me and advise me not to accept anything i.e. the check i gave them.

they will be sending him a letter explaining this in the am.

55 and older communities are common. Approach your realtor, (s)he should have known better before showing you that property.
