Legal Question in DUI Law in Florida

DUI off record

My son is 22 and two years ago recieved a DUI. He now would like to join the airforce, and would like to have his records seal or expunged. I printed out these papers, and you can do it with a DUI. Is there anyway to get this done. He wants to do something in his life and can't. He started going to school for EMT/Firefighter and learned he couldn't do this either. Please help.

Hi: I just read your question. Unfortunately, if someone was adjudicated guilty of a crime at sentencing, he/she cannot seal the record. If the court WITHHELD ADJUDICATION OF GUILT on a charge AND he/she has never been adjudicated guilty of another crime, the record may be sealed. Under Fla. law, a Court must adjudicate the defendant guilty. If the State had reduced the charge to reckless driving, a withhold could have been available. It didn't sound like that was the case with your son.

As an aside, a DUI conviction shouldn't preclude one from getting on with his or her life. Tell him not to get discouraged...keep trying. As time passes and he doesn't get into any more trouble with the law, people will understand a one-time mistake. Good luck. 'Hope this helps. Tom Rosenblum
