Legal Question in DUI Law in Florida

I had a fight with a guy friend today that wanted to drink a beer in my car while I was driving. I told him NO..and he said why.. I wouldnt get a ticket for anything..only he would.. Am I correcct in saying I would also be at fault even if I wasnt drinking ( other than moutain dew..lol ).. Thanks

The driver is deemed to be the one responsible unless the passenger admits that it his open container and thus he would be responsible. I wouldn't chance no matter who my friend was but that's your call.
