Custody issue

After a really nasty break up my ex-boyfriend and I decided to share custody of our two year old son. He was to keep him until the middle of November and then I would get him until the middle of Janurary. We did not have any papers filed, it was an agreement made between the two of us. He is now recanting on his promise and I want to know what my options are. Please help me!

Your question is a bit vague in that you do not specify where the child currently is, where you live and where your ex lives. If you are in Florida you would probably want and need to file a petition to establish paternity, child support and custody. I assume that the same would be true in Ct.

You have only one option: File an action for custody in the Superior Court and have the custody, support and visitation issues decided by a judge. Until there's a court order in effect, each parent has just as much right to custody of the child as the other. The cops will simply refer you to the court if they are called, so you may as well bite the bullet, pay the lawyer the money you didn't want to part with in the first place, and go to court.
