child's name change

I have been divorced for 3 1/2 years and have full sole custody of my 6 year old son. I would like to change his and my last name to my maiden name. I have a younger son who has my maiden name and would like for all of us to have the same last name. I would like to know how to go about getting his name changed and if his father has to give consent. He has not seen his father since he was 6 weeks old. His father is ordered to pay child support and does not pay and has made no attempt to contact us since we have left. I appreciate any help you can give. Thank you.

Re: child's name change

Your first step may be to move to have the father's parental rights terminated. That will remove him from any decision processes in the future (it may also releave him of future child support).
