Custody

My sisters kids were taken from her due to harsh living conditions. And are currently in custody of state. Do I as the uncle have any rights to take them?

When children are removed from the home of the parents or parent, the preference is to place the children with a relative. The relative must be approved by the department of social services before the children are placed with the relative.

It's not exactly a right to them. In the course of removal, the Dept. of Children & Family Services is supposed to inquire about relatives and the willingness to take the children. DCFS does a home study and a background check of the adults living in the house and then can placed them there upon the approved home study, etc.
