Legal Question in Family Law in Florida

divorce

My husband and I want to get a divorce. My concern is that I discovered that he had a drug problem and I believe that he is still using. We have 2 small children together and I am concerned for their safety if he is watching them. He had promised me initially that he would go to counseling, but has since then changed his mind. We are still living together because neither one of us has the money for a divorce and we are stuck in a lease for the house until July. Can I request that he be drug tested prior to being with the children?

Re: divorce

Hello: In response...yes, you can ask the court that he be required to prove he is not using drugs or going to counseling or he won't be able to have unsupervised visitation with the children. There are more details to explain about this type of situation and what the court can do. You would be wise to have an atty. represent you. If my office can be of assistance to you in North Fla., please give us a call. Tom Rosenblum
