Legal Question in Family Law in Florida

Ex-wife and her husband are planning to move out-of-state (they have 2 kids together). He has opportunity for better paying job, and wants to be closer to his family. Ex-wife and I have 8-yr. old son together, and they want to take him out of state, too, within the next 2 weeks. Divorce decree states that she cannot move child out of state. What can I do to stop this?

If she wishes to relocate more than 50 miles, she needs to comply with Florida's Parental Relocation Statute. If you think she is going to try to leave without complying with the Statute, you can file for a Temporary Injunction to Prevent Removal of Minor Child. I would suggest that you meet with a family law attorney in your area as soon as possible to discuss your options.

She has to get a court order or your written consent prior to the move.
