military retirement

need to find out all info on how to apply for a portion of my ex-husbands military retirement, how much would i be entitled to and who do i need to contact to file.

If you are filing for a divorce in Florida, then you are entitled to one-half of his retirement. Just make sure that you inform your attorney of this retirement to be certain that it will be included with the other assets of the marriage for purposes of equitable distribution.

If your marriage has been dissolved and the Final Judgment does not include any right to the military pension, you will have to file a post-judgment action to claim rights and explain the reasons why such claim was not made. You are entitled to one-half of the pension accrued during the marriage, however, your rights may be affected by other factors. You are advised to consult with a family law attorney who can advise you re legal options.
