modify court order

x-wife has custody of our 2 sons ages 14 and 16. they have lived with me for the last 3 years. she does sign and return my child support checks to me, but she doesn't pay anything to support our sons. i filed to modify the court order stopping my support and for custody after talking with her. she was served the modify but denies several section. is my next step to get a lawyer too or go though mediation. my sons had very low grade point avg. even below 1.oo and had failed grades while living with her. they were behind several grade levels. if they return to her they have both said they prob. won't finish school like her other son.

Your should get and attorney and go to mediation to see if you can resolve your cusotdy issues without the need and expense of having an evidentiary hearing.
