Legal Question in Family Law in Florida

Hi there, im asking this question on behalf of my brother who is going through legal matters with his ex girlfriend. They recently broke up, she won full custody, he's paying child support. He recently opened his email account and noticed one of his emails from his attorney were NOT marked unread. He opened up yahoo mail's account history log and is able to show his email account was accessed from an IP address from the city she lives in new york.

My question, does he have a case or can he take any legal action against her?
