Legal Question in Family Law in Florida

I had a question regarding getting my daughter a passport for vacations. I live in Florida and have a 4yr old daughter. I am not with the father, who is on the birth certificate - but do have a court order stating who is the custodial/noncustodial parent. I am the custodial. We also have a child support order of with he is over $12,000 in arrears. He does not follow any of our court orders. How is it fair he can just deny signing the consent form for the passport and there be nothing I can do?!? Is there anything I can do to bypass him? Can anything be done because he's so far behind in child support that will relinquish his say so in this matter, other than a civil contempt?!?

If all your court order states is that he is the father through paternity testing and then the amount of child support he is to pay, then you should be able to do as you wish as there is no visitation rights or parenting plan in existence. I suggest you file a Motion to Obtain Passport for Minor Child, get a Notice of Hearing, serve him with the papers and appear for the hearing. The Judge will prepare an Order to obtain passport for minor child.
