Legal Question in Family Law in Florida

signing over custody

Me and my boyfriend are about to get married and he has a child with his ex. She has him on child support but doesn't allow him to see his daughter. He has decided to sign over custody to his ex. Does he still have to pay child support? How do we go about signing the child over to his ex?

Re: signing over custody

If the mother is remarried, her new husband can adopt.

Otherwise, he needs to step up and be a dad. You can't just "sign over" a child. It doesn't work that way. Children have a right to have parents, even lousy ones like him. He needs to file for visitation rights (or file a motion for contempt if she's violating the rights he has) and pay his child support.
