Sole custody

My ex husband is absent, he doesn't see the children for almost a year now, he doesn't pay child support, doesn't call on their birthday and gives me a hard time everytime I need his authorization to travel out of state with the children. Can I request sole custody?

yes. You must petition the court for this relief.

One main issue is why you are not seeking to enforce the child support. If you can not afford an attorney, the local legal aid may be able to assist you.
