If am taking care of my son why should I have to pay child support

Child support is a calculation that depends upon the following facts: the amount of overnight time a child spends with each parent, who pays health insurance premiums, who pays day care/after school care/summer camp, each parent's respective net income (as defined in the statute).

If your net income is more than the other parent or if the other parent is paying other expenses for the child, then you may be responsible pay "support".

The answer to this question depends on certain circumstances. If you have and your ex or current girlfriend( making this assumption of non marriage based on the question) are in agreement and are taking care of the child without judicial intervention then you can go on this way and no one would be the wiser. If however your girlfriend has applied for public benefits from the state or has applied for child support (note in order to get public benefits you are required to file for child support) then you will be required to pay child support. Make sure however that you have all of your receipts just in case the issue of arreages ( back child support) comes up. However if you have physical custody of the child then you would not be order to pay child support however you would be entitled to receive support for the child in question.
