Legal Question in Civil Litigation in Florida

former employee seeks legal action

i received a certified letter from an attorney representing a former employer. the former employer insists i still have financial documents, discs, etc that belong to the company and in the letter demands that this property be returned or they will proceed with litigation against me. i terminated my employment with this small business for many reasons, but as a favor continued with her accountant trying to settle tax issues after i left. when the owner accused me of having an affair with her husband, i returned all property in my possession in an effort to sever ties with this crazy business owner. what do i do? she has harassed me by calling me, coming to my residence, slanderizing me around town. also in the letter the attorney requests a meeting with me to discuss business matters of which i have nothing to discuss.

***ALSO--is it a conflict of interest for this attorney to be representing this business owner as i have retained his services in the past for my own business?!???!

Re: former employee seeks legal action

Let me take the last first - if you have met with this attorney to discuss issues in this matter, then he is in a conflict. The fact that he has represented you in other unrelated matters does not per se disqualify him. However, when you say he has represented you in your business, I am not sure if that includes your former employer or services you provided.

As for bringing a lawsuit against you, I would seek the advise of counsel. If you have turned over all of the documents and do not have anything left, then what would their lawsuit do?

Best of luck.
