Legal Question in Immigration Law in Florida

My boyfriend is on F1 visa in Florida and I came to visit him on B2 visa 5 weeks ago. Couple of days ago he proposed to me and we decided to get married in 5 weeks from now and then change my status to F2. Can I ask a change of status right after we get married or I have to wait till 90-days period is over? I-94 is valid till the middle of January.

Hi,

As long as there was no intention of marriage when you entered the U.S., it is OK to be married and file for your change of status application with the USCIS. It is still recommended that you wait at least 60 days after entry to the U.S. before marriage and change of status application is filed with the USCIS.

Mr. Arora is correct. I suggest that you consult with an attorney with both you and your fiance present for long-term immigration planning as well.
