Auto Accident, Neither Party Insured

I was recently in an auto accident. Unfortunately I had let my policy lapse and thus am uninsured. The other individual involved in the accident was clearly at fault and was ticketed for the accident. Initially they said that they had insurance, but mysteriously, after finding out that i was uninsured they are now saying that their policy has lapsed as well and they are no longer insured. Should i contact their insurance company directly to verify this? My car is a total loss. What options do i have?
