Legal Question in Employment Law in Florida

Want to hire a marketting/sales person who is solely compensated on commission basis. One of the commission component is a portion of the monthly service charge from the client the person brings in. That means he will get some money every month as long as clients he/she brought in is still in contract and paying. Extending this if this person is not working with the company anymore, will I be able to pay the person the owed commission. Is there any restriction on this kind of recurring payment? What would be the type of employment for the person (contract, independent agent etc etc..). Apptreciate if you could give me an answer or give some references to use.
