Hurt Tongue

A year ago in Jan. (02) my husband and I were eating at Apple Bees restraunt. I cut my tongue there. I filled out an acident report and did everything their insureance people wanted me to do. This past summer I received a letter from them asking if I would release them for $200. I asked for $5,000. I went back to my doctor and got a note from him saying that the lump on my tongue would probably heal in 6 months. The insureance people called and offered my $500, I asked about the $5,000 and they did not say anything. Do I have a case or not? Thank you for your help. (By the way, I still have the lump on my tongue.) It bothers me once in a while.

It depends upon what caused the cut in your tongue

and whether you can prove they were negligent.

Assuming you believe Applebees did something to cause the damage to you, then you may have a negligence case against them for the amount of the damages you suffered (medical bills, pain and suffering). Not much money though, so tell them you want what you want, and if not, then you may need to seek the advise of legal counsel.
