Insurance co. said we were to be served shortly for accident 4 yrs ago.

If you are insured for the accident, then presumably the insurance policy provides for legal representation to defend against any case arising out of the accident and since the accident occurred over 4 years ago the statute of limitations may be a valid affirmative defense.

If the case was actually filed within the 4 year statute of limitations period then the claim could be properly filed.

If is the case then you should look at the claim and make sure that you have available insurance that would satisfy the claim against you. If you have plenty of insurance then you should be fine with the attorney that the insurance company provides.
