Legal Question in Personal Injury in Florida

If a person is represented by an attorney for almost four years from a car accident.

Does the statute of limitations still apply if represented by council?

And if not can that person attain a new attorney?

to pursue court litigation rather than settling?

Yes - You need to to file a lawsuit within four(4) from the date of the accident or there is a statute of limitations bar (you lose).You can retain a new atty any time to file a lawsuit.I would suggest you get a second opinion if you are in this situation. Yes, it still applies. Your attorney should be keeping track of the statute of limitations in order to file suit before the time expires. Once it does, you will never again have the opportunity to file a lawsuit as a result of that accident.
