Slip on wet floor in a Hotel

My wife slipped and fell on some Wet tiled steps when arriving at a hotel in Key West last year. I want to pursue a claim for personal injury compensation for her. She suffered a nasty double fracture of her Forearm (Ulna).

What laws apply to such matters, and how can I demonstrate that the hotel failed in their duty of care?

Is there any proven case law that I may rely upon to help my case? Thank you.

Based on the information provided, it appears that your wife has a viable cause of action against the hotel and possibly against other parties for negligence. Given the nature of the injury, the claim may involve substantial money damages. Why have you waited this long to inquire about a possible claim? Was there an incident report taken by the hotel? Was your wife taken by ambulance to a nearby hospital for medical attention? You do need an attorney in Key West to investigate the claim and evaluate if the hotel was negligent or not. The laws of Florida apply. Water always makes a tile floor slippery, but was it rainwater on an open outdoor walkway? Or was the water spilled indoors by a waiter? Was the tile appropriate for the location? What was the coefficient of friction? Only an experienced attorney who has possession of all the facts will be able to advise you if it is worthwile to proceed on a contingent fee basis. Even if there is no liability, the hotel may have medical payments insurance to pay bills up to $5,000 or $10,000 depending upon the policy terms.
