generally, you have 4 years to file suit against a person that negligently damages your property, but 5 years to sue your insurance company if they have failed to pay for covered damage to your car. There are some exceptions -- for instance -- if the state or a governmental entity damaged your car or if the insurance copmpany is in receivership, so do not delay.
