Legal Question in Social Security Law in Florida

Money due back--over payment

I am on Ltd. insurance,through the Co. I work. I applied for social security disability, as my Ltd.insurance required me to do.

Social security granted me total disability. S.S.

says they don't pay you for the first 5 months.

My Ltd ins. payed me until S.S. sent me a letter of how much money I would be receiving.

now my Ltd.ins. want's that 5 months pay back, that

S.S. said I had to wait.

MY Ltd. I have I paid for it weekly,it's not cheap.

Than for the first 5 months, I loose part of my income. That just dose not seem fair. I am a 61 yrs. young, with a 10 yr. son. He is getting his Dad,s S.S.

Please help me under stand why I have to take the lost.

Your insurance benefits are determined by the policy that you purchased. Ask the company representative to explain to you why no benefits for 5 months when you received no SS for 5 months. If the explanation is not based upon the policy or is not clear, see an insurance attorney for assistance. Often insurance companies deny benefits wrongfully or in violation of ambiguous terms in the policy. These ambiguous terms are resolve in favor of the insured.
