Legal Question in Wills and Trusts in Florida

Injunction to view canged trust or will

I helped my Aunt and Uncle move from Ca. to Fl. in 1997. I was appointed, excecutor, health care proxy and power of att. in his revocable trust. I just found out he changed those appointments and made his live in care taker all the above. I know he is not lucid ( Major strokes). The care taker will not let me see the new trust. Can you advise on how to file an injunction in order to get a copy of the trust and get a court appt. guardian if needed. He is 84 yrs. old and I suspect some undu influence by the care taker. I believe this situation needs to be examined. If the will has been altered to the care takers advantage, then I will seek a remedy if one is available. For now, I need the forms and info on how to get a copy of this trust. Your advise is greatlt needed and appreciated. Thanks

Re: Injunction to view canged trust or will

As nephew, you can certainly petition a court to have a guardian appointed. His mental faculties and any undue influence can then be tested.
