Legal Question in Workers Comp in Florida

attorney fees

Is it a normal practice for a court to approve my attorney $4000.00 for attorney fees in a workers comp settlement case before there has even been a settlement? I thought they don't get paid until the settlement since that is what the attorney gets paid a percentage of as per attorney.

In a workers' compensation case, an attorney is entitled to recieve compensation when their efforts have resulted in the provision of some benefit (disability payment, medical care, medical device, etc...) to the injured worker. Once the benefit is provided the attorney gets paid. This may have nothing to do with the overall settlement of the case. In fact, settling the benefit and attorney fee issue may actually help advance the case to overall settlement.
