Legal Question in Workers Comp in Florida

I have no confidence in my WC Lawyer

I had suspicions that my WC Lawyer's only interest in my case was the fee to be collected. This was further evidenced during a recent hearing as I listened to my lawyer tell my story with the wrong dates, facts, etc. To add to my distress I felt that he was not looking out for my best interests and was pushing for a settlement that left me holding the bag for costly future medical care, let alone loss of substantial earnings which drastically affected my spouses and my lifestyle.

I am an RN who was injured by a confused patient in a Florida hospital. The assault resulted in a torn rotator cuff, herniated cervical disk with cord compression resulting in parathesias and pain syndromes. I was injured in June 2006 and have since been unable to work,on high dose narcotics under the care of pain management. I have gotten the run around regarding aggressive treatment. I was terminated from my job in August 2007. Upon facing the foreclosure of my home, I chose to move to North Carolina to be closer to family and make an attempt to salvage my life.

I need an attorney who will work to look out for my rights and interests, and take on a case that I'm afaid may be damaged due to my currrent lawyer's ineptness.

You are not married to any attorney. I suggest you contact another attorney in your area who does workers' compensation to obtain a second opinion and then make a decision as to whether you should obtain new counsel.

You have every right to change lawyers. You need to find a Board Certified Workers' Compensation lawyer who has an office in the area where your accident took place. The Florida Bar website can assist. Good Luck.

We always suggest trying to reconcile with your attorney via a scheduled appointment. They either respond to your concerns, or they do not. You can make your decision accordingly.

If there is no chance of reconciliation, I would suggest contacting a fellow WILG (Workplace Injury Litigation Group) member in Florida. This is a group of dedicated, private practice workers' compensation attorneys that represent only injured workers. They share information and strategy with each other nationwide. Google for their website and go from there.

I assume there are no NC connections that would make this a NC case? In any event, good luck!
