Legal Question in Workers Comp in Florida

Workmans Compensation

My husband was out on workmans comp and now his employer is asking for $1000 to pay our health insurance that my husband would have had deducted from his paycheck. Does workmans comp pay for any of that?

Re: Workmans Compensation

Usually whatever portion of the premium you were responsible for prior to the accident, you will be responsible for after the accident. Remember, employers are not required to provide fringe benefits like health insurance in Florida. However, if the employer paid for all of it prior to the accident, they should continue to pay for all of it. Otherwise, his Average Weekly Wage should be adjusted to reflect the employers portion of the premium once the benefits are cancelled.
