Legal Question in Credit and Debt Law in Georgia

I am unemployed and have started receiving workmans comp payments. I have two vehicles financed that i will have to let go back to Drivetime. I can`t afford to keep the cars and pay rent and utilities too. The car company said they will garnish me. Can they garnish my workmans comp payments or would i have to file bankruptcy? I once had a form letter to send to the creditor stating that they couldnt do this but i want to be sure.

If you let the vehicles go back you will still likely owe a large sum. While they canot garnishee the worker's comp, they can seize your bank account, and, years later, they can grab the paycheck you get then.

If you are eligible to file bankruptcy, it is often better to do it whole unemployed. Feel free to call me to give me details where I can determine if that is in fact an option for you.
