Legal Question in Criminal Law in Georgia

What is the law?

I have a young relative that was recently arrested for from what I gather an accessory to a misdomeaner. No evedince was found against him but he is still facing a 10-15 year sentence. He has no priors and from what I'm told is not elligible for a bond hearing for several months. Is this truly the law in Gorgia, one is guilty till proven innoncent??? Or am I not getting the whole story.. I,m really puzzeled, your reply would be greatly appreciated.

Re: What is the law?

You've been lied to (or completely misunderstood). The maximum sentence for a misdemeanor is one year. 10-15 years is likely a serious felony. Additionally, all people arrested in Georgia are entitled to a first appearance hearing within 48 hours; bond is considered at most such hearings unless his charge is to serious to be bondable in the court he is in. As in all states, a person is innocent until proven guilty.
