Statute of limitations

In Oct. of 1998, my friend was stopped by a dept store for not paying for an item that cost $5. They did not call the police or file charges. They just got a copy of his license and made him pay for the item. A couple of months later, he received a letter from their lawyer wanting a restitution fee of $150 and they would not press charges. We paid it to make it go away. Then, yesterday we received a letter from a different attorney because the store has been sold. They want us to pay another $150 restitution fee or they will press criminal charges and sue us. What is the statute of limitations that they have to file criminal charges and to sue since the actual act was back in 1998?

In Georgia, prosecutions for misdemeanors must be commenced within two years of the commission of the crime, usually. There may be an exception where the defendant does not reside in the State.
