Legal Question in DUI Law in Georgia

record expunged?

I would like to know how long before a dui is expunged from someones record. If someone gets one now and had one 8 0r 9 years ago, is it still on record? and also, do the cops have the ''right to search a vehicle, if so must they tell you before doing so??

For license suspension and various sentencing purposes, the number of DUI convictions within a five year period is what counts. However, to answer your question specifically, a DUI conviction never drops off your record. This information is available to any court no matter how long ago the conviction occurred.

As to a search of your vehicle, the police must have probable cause to search your vehicle, or it must be a search incident to a lawful arrest, or they must have your consent.
