Legal Question in Family Law in Georgia

Child Support/ Custody

My boyfriend got divorced back in August 2004. He is to pay child support. The problem is that his ex wife does not even have the child and has not had her living with her for over a yr and a half. The child lives with my boyfriend's parents. He is afraid that if he takes this to court that she will leave the state with the child AGAIN. Is there any way this would hold up in court to have both parties pay his parents support, or to reduce support? And is there any way to ensure that the ex wife can't move out of state with the child, since that was not brought up in th divorce papers? Please help us with some anwers. He says that the fathers get the short end of the stick in Georgia, please help prove him wrong.

Re: Child Support/ Custody

You should immediately consult with a local attorney with an eye toward ASAP getting her served with papers seeking to order her not to remove the child. Once she is served, even if she leaves the state, a GA court still retains jurisdiction over her and the child.
